The European Court of Human Rights (E.C.H.R.), based in Strasbourg, is an international judicial body, established in 1959 by the European Convention for the Protection of Human Rights and Fundamental Freedoms, which regulates its operation, also providing a catalogue of fundamental rights and freedoms that the signatory States are obliged to respect.

With this in mind, the Court, in performing a subsidiary function with respect to domestic courts, has ruled on different occasions on the incompatibility of national rules with conventional rules.
